1. About EverGrain


These Standard Terms and Conditions of Sale (“Terms”) apply to all online orders placed with EverGrain through its website, mobile platforms, or other digital channels within Pakistan.

By placing an online order, the customer (“Customer”, “you”) confirms that they have read, understood, and agreed to these Terms, which constitute a legally binding electronic contract under the Electronic Transactions Ordinance, 2002. [lex-form.com]

2. Products


EverGrain supplies grains, flours, seeds, and related food products for consumption and trade within Pakistan.

Product descriptions, images, and nutritional information displayed on the Website are provided for general guidance. Minor variations in packaging, labeling, or appearance may occur due to supplier or regulatory requirements without affecting product quality.

All products are subject to availability. EverGrain reserves the right to limit quantities or discontinue products without prior notice.

3. Pricing


All prices displayed on the Website are in Pakistani Rupees (PKR) unless stated otherwise and exclude delivery charges unless explicitly mentioned.

Prices may change at any time; however, the price confirmed at checkout will apply to the relevant order. In case of an obvious pricing or typographical error, EverGrain reserves the right to cancel the order and refund any amount paid.

4. Orders and Acceptance


Placing an online order constitutes an offer to purchase. An order is considered accepted only once EverGrain confirms the order and successfully processes payment.

EverGrain may refuse or cancel orders in cases including, but not limited to:

  • Product unavailability
  • Incorrect pricing or product information
  • Failure of payment authorization
  • Suspected fraud or misuse

5. Payment


Payment for online orders must be made in full at checkout using payment methods made available on the Website, including bank‑approved digital payment systems regulated by the State Bank of Pakistan (SBP). [lex-form.com]

Orders will not be processed or dispatched until payment has been successfully received and verified.

6. Delivery (Pakistan Only)


EverGrain delivers orders within Pakistan only. Delivery timelines are estimates and may vary due to logistics, weather conditions, public holidays, or other circumstances beyond EverGrain’s control.

Risk of loss and ownership of goods pass to the Customer upon delivery to the provided address. The Customer is responsible for ensuring accurate delivery details at checkout.

7. Inspection and Complaints


The Customer must inspect products immediately upon delivery.

Any complaint involving damaged, missing, expired, or incorrect products must be reported within 48 hours of delivery, along with supporting evidence (such as photographs or delivery receipt).

Failure to notify EverGrain within this period will be treated as acceptance of the products.

8. Returns and Refunds


Due to the nature of food and consumable products, returns are accepted only where required by law or where the product is:

  • Defective
  • Incorrect
  • Damaged at the time of delivery

9. Storage and Use


The Customer is responsible for proper storage and handling of products in accordance with packaging instructions. EverGrain is not responsible for spoilage, contamination, or quality issues arising from improper storage after delivery.

10. Consumer Protection

11. Limitation of Liability


To the maximum extent permitted by Pakistani law, EverGrain’s liability for any claim related to an order is limited to the amount paid for the affected products.

EverGrain shall not be liable for indirect, incidental, or consequential losses, including loss of profit or business interruption.

12. Force Majeure


EverGrain shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, strikes, government actions, supply chain disruptions, or transport failures.

13. Intellectual Property


All Website content, including text, logos, product names, images, and trademarks, is the property of EverGrain and protected under applicable intellectual property laws of Pakistan. Unauthorized use is strictly prohibited.

14. Privacy and Data Protection

15. Governing Law and Jurisdiction


These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.
